ASSUMPTION OF RISKS & HOLD HARMLESS AGREEMENT

At Kick Azz Fishing Charters we care about the safety of all clients and crew. While boating and charter fishing can be a potentially dangerous activity we strive to offer the highest of safety standards. Please be aware accidents potentially could happen to the crew or clients. We do our best to mitigate all risks but if an accident arises we will return to the dock.

Alcohol Disclaimer : If the clients consume ANY amount of alcohol on our boat or before getting on the boat Kick Azz Fishing Charters is NOT responsible for any of the clients actions or injuries including slipping and falling on the boat or dock. Being under the influence of alcohol is dangerous on boats and could lead to potentially serious injury or death.

Please Be Advised : All clients aboard any boat operated by Kick Azz Charters or their captains need to know “you” the client is aware that fishing involves many risks, dangers and hazards including, but not limited to: accidents which occur during transportation or travel to and from the fishing; impact, getting hooked, collision with rocks, trees, logs, deadfall, boats, rafts, equipment or other vessels; drowning; changing and inclement weather conditions including storms, high wind, high waves, and lightning; encounters with domestic or wild animals and fish; failure of the equipment; failure to operate the equipment safely or within one's own ability; negligence on the part of other participants; and NEGLIGENCE ON THE PART THE RELEASEES, INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN FISHING OR MY USE OF THE EQUIPMENT.

By booking the charter with Kick Azz Fishing Charters “you” the paying client accept all the responsibility and actions of your party.
